Terms & Conditions

Any booking that you make through the Website is conditional on accepting these General Terms and Conditions, the legal statement and privacy policy (the “Terms and Conditions”). The Terms and Conditions form an integral part of the Website and cannot be separated from the general contracting conditions, operations or bookings.

By accessing, browsing and using our (mobile) website or any of our applications through whatever platform (referred to as the "Website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement) and all applicable laws and regulation governing the Website and bookings transacted via the Website. If you do not agree to be bound by the Terms and Conditions, then you must not proceed with using the Website and/or the booking

These terms and conditions, may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone.

The webpages, the content and infrastructure of these pages, and the online reservation service provided on these pages and through the website are owned, operated and provided by Premier Accomodation Limited and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

1.1. Definitions and interpretation

The following definitions have the same meaning whether they are singular or plural.

‘Customer', ‘The Customer’, ‘User’, ‘Visitor’ or ‘You’ means a customer who reserves and/or books one or more Services offered on the Website.

‘General Terms and Conditions' means these general terms and conditions for booking and use, as amended from time to time.

‘HotelBeds’ means HotelBeds, S.L.U., a legally-constituted Spanish travel agency, based at Complejo Mirall Balear, Camí de Son Fangos, 100 - Torre A, 5ª. Planta, 07007 Palma de Mallorca, Spain with Wholesale/retail licence number BAL- 512 M/D granted by the Ministry of Tourism, Government of the Balearic Islands (Spain), tax identification code B-57218372 and registered in the Mercantile Register of Mallorca (page PM-44863, volume 2007, and folio 118).

‘Platform’ means the (mobile) website on which the Service is made available owned, controlled, managed, maintained, and/or hosted by tripgeek.com.

‘Service’ means the online reservation service (including the facilitation of payments) of various products and services as from time to time made available by Accommodation Providers on the Platform.

‘Accommodation Provider’ means the provider of accommodation (e.g. hotel, motel, apartment, bed & breakfast, home rentals), and any other travel or related product or service as from time to time available for reservation on the Platform.

‘Website’ means the (mobile) website that you are currently using, www.tripgeek.com, and any sub-domains of this site unless expressly excluded by their own terms and conditions.

‘tripgeek.com’, >‘TripGeek’ >‘Trip Geek’,‘Premier Accomodation Ltd’, ‘us’, ‘we’ or ‘our’ means Premier Accomodation Limited, a limited liability company incorporated under the laws of Ireland, and having its registered address at 13 Upper Baggot Street, 2nd Floor, Dublin, D04 W7K5, Ireland.

2. Scope of our Service

These General Terms and Conditions apply to offering and providing of the Services by tripgeek.com. tripgeek.com owns and operates the Website which acts as an interface between the Customer and the various Accommodation Providers offering the Services, including HotelBeds.

We provide an online Platform through which Accommodation Providers can advertise their products and service for reservation/s, and through which Customers of the Platform can make such reservations. By making a reservation through tripgeek.com, The Customer enters a direct legally binding contractual relationship with the Accommodation Provider with which you make a reservation or purchase a product or service (as appropriate). From the point at which you make your reservation, we (TripGeek) act solely as an intermediary agent between you (The Customer) and the Accommodation Provider, sending the details of your reservation to the relevant Accommodation Provider(s) and sending you a confirmation email on behalf of the Accommodation Provider.

The information that we provide on our Website is based on the information supplied to us by Accommodation Providers through a combination of (1) technical integration between our Platform and that of HotelBeds Platform and (2) directly contracted Accommodation Providers. For the HotelBeds Platform, the Accommodation Provider updates its information on HotelBeds Platform to which TripGeek have no control on the content or quality assurance. Any incorrect or misleading information is not the responsibility of TripGeek, however, anything reported to us will be followed up with HotelBeds and/or Accommodation Provider. Directly contracted Accommodation Providers are given access to an extranet on our Platform through which they are ultimately responsible for updating pricing of product and services (including room rates), room availability and other information which is displayed on our Platform. We will use reasonable attention and care in performing our Service, however, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of HotelBeds or our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Accommodation Provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including pricing and availability) displayed on ours and HotelBeds Platform. Ours or HotelBeds Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any Accommodation Provider (or its facilities, venue, products or services) made available.

We offer our Service for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, reservations, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.

3. Bookings Process

3.1.Booking

Simply search for a destination, date range, number of rooms and people then proceed to the booking page. Details of the selection will be shown on each page of the Website. You should carefully check the dates, the price, the destination, and the service Accommodation Provider details before completing the booking. Information relating to the cancellations policy, costs and details applicable to the booking will also be displayed during this process.

To confirm a booking, the user must be authorised to make the booking by the Customer and by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made.  By making the booking, the Customer is confirming that all persons named on the booking accept the Terms and Conditions and that the Customer will inform the other persons named on the booking of the confirmation details and any other appropriate information.  By making the booking the Customer also becomes responsible for making all payments due to TripGeek or the Accommodation Provider.

Once TripGeek has received the Customer booking and all appropriate payments, TripGeek will, subject to availability, confirm the booking once the service Accommodation Provider concerned confirms to TripGeek. TripGeek will confirm by issuing a confirmation e-mail containing a booking reservation. There are occasions when a booking is confirmed or pending, when Accommodation Provider has changed the pricing or availability at the same time of the booking, in these rare occurrences TripGeek will notify the customer within 48 hours of the booking to support any rearrangement as required

The booking request will not be confirmed by TripGeek and the transaction is not considered completed until the Customer has paid on time the full price of the services, irrespective of whether the consumer, intermediary or the remaining interested parts, have paid the referred price to the Customer. Therefore, TripGeek will confirm the booking once the full price is paid by the Customer.

Except where the parties have agreed on payment terms in a financial agreement, under no circumstances will the booking be deemed complete until the Customer has paid TripGeek the price of the services, independently of the consumer, intermediaries or other parties concerned having paid the aforementioned price to the Customer. Consequently, TripGeek will only confirm the bookings once the payment has been made in full to TripGeek.

Customer shall check the booking reservation carefully as soon as the Customer receives it and contact the TripGeek customer services immediately if any information which appears on the booking reservation or any other document appears to be incorrect or incomplete. As TripGeek acts only as Customer travel agent, TripGeek will have no responsibility for any errors in any documentation except where those errors were made by TripGeek while processing the booking.

Such a reservation or booking confirmation shall include:

  • Booking reference

  • General booking details

  • Breakdown of amount and/or invoice to be paid by Customer to TripGeek (or subsidiaries/affiliates) including any taxes due or included

  • reservation or deliverable documents. The documents provided by TripGeek are for the sole reference of the Customer.

The Customer shall present reservation details with TripGeek reference at the service Accommodation Provider/accommodation establishment upon check in.

By completing a booking, you agree to receiving an email which we may send you once confirmation is received from the Accommodation Provider. You also agree to receiving certain information and offers (including third party offers to the extent that you have actively opted in for this information. Please see our privacy and cookies policy for more information about how we may contact you. To complete and secure your reservation, you will need to use your correct email address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card number.

Any claim or complaint against tripgeek.com or in respect of the Service must be promptly submitted, but in any event within 14 days after the checkout date. Any claim or complaint that is submitted after the 14 days period, may be rejected and the you forfeit your right to any (damage or cost) compensation.

 

3.2.Group Bookings

TripGeek Platform only allows individual bookings. You are only permitted to book up to 5 rooms per stay for an individual booking. Should you submit a booking of 6 or more rooms per stay, either in one or several individual bookings, then this will be considered a “Group Booking”. Group Bookings will be subject to confirmation by the Accommodation provider and may result in modification or cancelation of such booking or booking terms at the Hotel´s discretion.

 

3.3.Cancellations

A booking can be cancelled directly on the website by either providing email and booking reference (if you are not registered) or logging in with your registered details. Cancellations are all subject to the Accommodation Provider booking and cancellation policy which is not governed or managed by TripGeek. TripGeek is not liable for any cost incurred to you for cancellation.

If a cancellation has occurred immediately after the confirmation of the booking, the reservation will become invalid. Consequently, the booking will be deemed invalid by TripGeek and the service Accommodation Provider. Moreover, if the service Accommodation Provider renders the services, TripGeek shall not be responsible for its payment.

In the event of cancellation or partial cancellation of a booking by the Customer, charges may be imposed by the applicable Accommodation Providers. Where a cancellation affects more than one person on the booking, any applicable cancellation charge will be applied in respect of each person on the booking.

Please always refer to the Booking and Cancellation Condition notified in the booking process for more details.

If a Customer does not show for the first night of the reservation and plans to check-in for subsequent nights in the reservation, the Customer must confirm the reservation changes with TripGeek no later than the original date of check-in to prevent cancellation of the whole reservation. If the Customer does not confirm the reservation changes with TripGeek the whole reservation may be cancelled and refunds will only be due to the Customer in line with the Booking and Cancellation Conditions of the applicable Accommodation Provider as notified in the booking process.

We reserve the right to cancel your booking if full payment is not received in a timely fashion.

 

3.4.No-Shows

No-show by you or the all person/s on booking at the accommodation establishment without warning shall be considered a cancellation. No reimbursement shall be made in the event of a 'no show' without prior consultation with, and express authorisation from, HotelBeds and/or TripGeek, who shall charge you according to the Booking and Cancellation Policy set out at the time of booking, The amount chargeable may range from the cost of one night to 100% of the amount of the booking

 

3.5.Miscellaneous Conditions

 

3.5.1.Children

Special conditions for children are agreed upon with each service supplier and are not based on any one criteria; therefore, and given that each accommodation establishment/supplier applies its own special conditions or discounts, you should enquire about this point before making the booking. 

Cots (UK) / Cribs (US) – In the event that this service is required, this shall be indicated when making the booking, as some accommodation establishments have a limited availability of such items. This extra service can be paid by the consumer directly at the establishment if required.

 

3.5.2.Third Person In Accommodation Services

Almost all hotels will treat a booking for a third person as a double room with an extra bed. An additional charge may be applicable for an extra bed to be occupied by an adult, as this varies depending on the hotel. There are hotels with very few available extra beds, so it is imperative to ensure availability when making the booking. Failure to do this may result in non-availability of the extra bed at the hotel, with no right to claim any service provision or amount whatsoever from TripGeek.

 

3.5.3.Classification (Star Ratings)

The indication of the comfort level given to hotels in the descriptions on the Website corresponds to a classification based on local standards in that country, which can differ from standards expected of your country. This classification is provided only as an indication. Customers should be aware that standards can vary between hotels of the same class in different countries, and even in the same country. It is important to read carefully the individual hotel descriptions. Accommodation in all hotels, whatever the rating, is in standard rooms unless otherwise stated.

4. Payment

Certain Accommodation Providers offer the opportunity for reservations to be paid (wholly or partly and as required under the payment policy of the accommodation) to the Accommodation Provider during the reservation process by means of secure online payment. tripgeek.com facilitates (through one or more third party payment gateways) the payment of the relevant reservation on behalf of the Accommodation Provider. Payment is safely processed from your credit/debit card or bank account to the TripGeek through a third-party payment gateway and TripGeek immediately transfer the amount to the Accommodation Provider (minus TripGeek fees). Any payment facilitated by us for and on behalf of, and transferred to the Hotelbeds or Accommodation Provider will be considered part or full payment of the reservation amount as set out by the booking and cancellation policy.

For certain (non-refundable) rates or special offers, please note that Accommodation Providers may require that payment is made upfront by credit card, and therefore your credit card may be pre-authorised or charged (sometimes without any option for refund) upon making the reservation. Please check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your reservation. You will not hold tripgeek.com liable or responsible for any (authorized, unauthorized or wrong) charge by the Accommodation Provider and not claim or reclaim any amount for any valid or authorized charge by the Accommodation Provider (including for pre-paid rates, no-show and chargeable cancellation) of your credit card.

In the event of credit card fraud or unauthorised use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subject to a deductible (usually set at EUR 50 (or the equivalent in your local currency)).

5.Prices and Rates

Prices quoted on the Website are per room and are inclusive of all indirect taxes (GST, ITBIS, VAT or other similar taxes) except any tourist/city tax, which will be payable by the consumer at the hotel; therefore, the price paid by the Customer shall include all indirect taxes but the ones specified above. Any taxes that need to be paid locally or in advance will be displayed clearly during the booking process. Any increase or change in the applicable tax will be directly added to the prices offered in these Terms and Conditions.

Applicable taxes may be charged by the accommodation in the event of a no-show or cancellation fee.

The price for hotels and other accommodation establishments as specified in the booking confirmation, with the exception of those accommodation establishments in which the inclusion of other services is specifically indicated. In most hotels, the earliest check-in time is after 14:00 hours, and the latest check-out time on date of departure is 12:00 hours. The hotel may offer changes to these times with additional costs associated with the change, these changes should be discussed with the hotel directly and TripGeek is not responsible for the check-in and check-out times agreed out of the original booking or any costs associated with the change.

Please check the relevant product, service and reservation conditions and details thoroughly for any conditions (non-cancellable or non-refundable) prior to making your reservation. The booking and cancellation conditions are set out by the Accommodation Provider and TripGeek accepts no liability for the Customer if they have overlooked the conditions.

The currency converter is for information purposes only and should not be relied upon as accurate and real time; actual rates may vary.

Obvious errors and mistakes (including misprints) are not binding.

All special offers and promotions are marked as such.

6. Impossibility of handwritten signature

Due to the special characteristics of the electronic commerce, the Customer hereby acknowledges the impossibility of handwritten signature for this transaction. Therefore, the Customer hereby accept that there is no need for handwritten signature and the Customer also accept to be bound by the acceptance of the Terms and Conditions of the Website upon making the booking.

8. Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Accommodation Provider as made available on our Platform, (iii) the services rendered or the products offered by the Accommodation Provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Accommodation Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Whether or not the Accommodation Provider has charged you for your room, product or service, or if we are facilitating the payment of the (room/reservation) price, you agree and acknowledge that the Accommodation Provider is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the (room/reservation) price to the relevant tax authorities. tripgeek.com is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (room/reservation) price to the relevant tax authorities. tripgeek.com does not act as the merchant of record for any product or service made available on the Platform.

By uploading photos/images onto our system (for instance in addition to a review) you certify, warrant and agree that you own the copyright to the photos/images and that you agree that tripgeek.com may use the uploaded photos/images on its (mobile) website and app, and in (online/offline) promotional materials and publications and as tripgeek.com at its discretion sees fit. You are granting tripgeek.com a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as tripgeek.com at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, accommodation owners) due to tripgeek.com publishing and using these photos/images. tripgeek.com does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of tripgeek.com. tripgeek.com disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by tripgeek.com at any time and without prior notice.[TP1] 

9. Intellectual property rights

Unless stated otherwise, the software required for our services or available at or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by tripgeek.com , its Accommodation Providers, Hotelbeds or providers.

The Customer acknowledges and agrees that any element and intellectual property rights pertaining thereto (including without limitation all commercial names, trade names, copyrights, logos, patents, trademarks, service marks and trade secrets) in the Website (including without limitation its Terms and Conditions rules, policies and operating procedures), received or acceded are the exclusive property of TripGeek or its Accommodation Providers,

All trademarks, copyright, logos, database rights and other intellectual property rights in the materials on the Website (as well as the organisation, look and feel, and layout of the Website) together with the underlying software code are owned by TripGeek. The Customer and any user may not use, copy, modify, alter, publish, broadcast, promote, market, integrate, distribute, sell or transfer any material on the Website or belonging to TripGeek or the underlying software code whether in whole or in part without TripGeek prior written consent. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

10. Miscellaneous

To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Irish and UK law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in the UK or Ireland.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

The online reservation service is rendered by Premier Accomodation Limited, which is a private limited liability company, incorporated under the laws of Ireland and having its offices at 13 Upper Baggot Street, 2nd Floor, Dublin 4, D04 W7K5, Ireland and registered with the Companies Registration Offices in Ireland under registration number 587017.
